17 Giugno 2010 - Ancona, Macerata, Fermo, Ascoli Piceno e Pesaro - Urbino

L’Associazione Radicali Marche con un azione congiunta e coordinata a livello regionale, ha presentato oggi presso la Regione, tutte le cinque Province e tutti i Comuni capoluogo di Provincia una richiesta di accesso agli atti finalizzata ad acquisire la situazione patrimoniale e tributaria degli eletti e dei nominati.
Questa iniziativa fa parte di una più ampia operazione di legalità e trasparenza, collegata all'istituzione dell'Anagrafe Pubblica degli Eletti (APE). In tal senso i Radicali sono convinti che "la visibilità dall'esterno, aumenti la sicurezza all'interno", ovvero che porre l'eletto ed il nominato sotto la lente del cittadino, in modo che questi possa conoscerlo, seguirlo nella sua attività politica, monitorarne le scelte e gli "interessi", sia in primo luogo anche una potente azione de-corruttiva.
La legge n. 441 del 5/7/1982 (ripresa dalla legge regionale n.4 del 3/3/1984) sancisce il diritto a ciascun elettore di conoscere le dichiarazioni obbligatorie relative alle situazioni patrimoniali, ai redditi e alle spese elettorali sostenute. Anzi, la normativa prevede addirittura che venga assicurata la pubblicità della situazione patrimoniale e tributaria di eletti e nominati mediante pubblicazione degli atti sul bollettino dei vari enti.
Con questa iniziativa i Radicali vogliono pertanto ristabilire il diritto alla conoscenza dei cittadini marchigiani, diritto più volte violato dalla Regione, dalle Province e dai Comuni. Un esempio su tutti: solo nel 2007 (BUR n.79 del 18/9/2007) sono state pubblicati i redditi dei Consiglieri Regionali degli anni 2000- 2001, oramai non più in carica.
In conclusione i Radicali Marchigiani sono pronti e si batteranno con tutte le loro forze per garantire al cittadino la conoscenza di ogni informazione indispensabile a garantirgli un voto consapevole. Insomma, mai come oggi, il nostro motto sarà "Conoscere per deliberare".

DICHIARAZIONE SPONTANEA di Francesco Ciclosi,
Tesoriere dell’Associazione Radicali Marche

L’iniziativa odierna che ho coordinato come Tesoriere dell’Associazione Radicali Marche, e che mi ha personalmente visto presentare una richiesta di accesso agli atti presso la Regione Marche, la Provincia di Macerata e il Comune di Macerata, si prefigge di verificare gli obblighi dettati dalla legge n.441 del 5/7/1982.
Tale norma prevede che le informazioni relative alla situazione patrimoniale e tributaria di eletti e nominati sia acquisita dagli enti e poi diffusa ai cittadini mediante pubblicazione in apposito bollettino per il Comune o per la Provincia, oppure sul BUR per la Regione.
Nello specifico la legge si applica ai consiglieri regionali, ai consiglieri provinciali, ai consiglieri comunali ed ai Direttori Generali dei comuni capoluogo; nonché ai Presidenti, Vicepresidenti, Amministratori delegati e Direttori generali di Istituti ed Enti pubblici partecipati dalle Autonomie Locali o la cui nomina spetti “alla politica”. A titolo esemplificativo penso all’APM, piuttosto che alla TASK, piuttosto che al caso clamoroso dell’ASUR Marche.
Inoltre in caso di inadempienza degli interessati, la norma sancisce che, previa diffida, i nominativi dei soggetti inadempienti vengano pubblicati nell’albo comunale o provinciale. Purtroppo è da rilevarsi la mancanza della norma sanzionatoria che, molto spesso in passato, ha indotto tanti amministratori a non rispettare gli obblighi di legge.
In tal senso la nostra iniziativa fa parte di una più ampia operazione di legalità e trasparenza, che deve culminare nell’istituzione dell'Anagrafe Pubblica degli Eletti (APE). In questa prima fase ci siamo preoccupati di indagare l’attuale rispetto delle norme esistenti in materia di trasparenza, “bussando con insistenza”, affinché tutti i cittadini marchigiani si vedano riconosciuto il diritto, già sancito dalla legge, di conoscere le informazioni economico-patrimoniali di eletti e nominati, potendo così meglio vigilare sul loro operato.
Ora, è giunto il momento di avviare la seconda fase che si articolerà in tantissime azioni capillari nei nostri enti locali, mediante la presentazione di proposte di iniziativa popolare, petizioni e referendum. Ogni iniziativa sarà finalizzata alla realizzazione di una vera e concreta iniziativa di trasparenza e legalità “nella politica” mediante l’istituzione dell’APE, ovvero dell’Anagrafe Pubblica degli Eletti.
Sono comunque sicuro e fiducioso che questa battaglia non ci vedrà soli, ma potrà trovare consensi in tanti amministratori che da sempre si distinguono per il profondo senso civico ed istituzionale.
In conclusione i Radicali Marchigiani sono pronti e si batteranno con tutte le loro forze per garantire al cittadino la conoscenza di ogni informazione indispensabile a garantirgli un voto consapevole. Insomma, mai come oggi, il nostro motto sarà "Conoscere per deliberare".
